Divorce is never an easy process. The decision to separate from your significant other can be one of the most mentally exhausting processes. When it comes to divorce, people think about the lengthy and expensive court procedures. However, divorce is of two types -contested and uncontested. 

When you and your partner mutually agree on all the terms, you may pursue an uncontested divorce, making the procedure easier. There are various perks of going with an uncontested divorce which we will be discussing later in this blog. What happens in an uncontested divorce?

An uncontested divorce usually settles out of court, reducing the hassle of lengthy court procedures. You can file an uncontested divorce only when you and your partner agree on all the aspects of the divorce, including property division, child custody, spousal support, and more. Usually, you can negotiate with your partner and sign a divorce agreement settlement which constitutes all the information about your agreements.

However, a problem may arise if the agreement is unfair to either of the party involved. 

Compared to contested divorce, uncontested divorce is less costly and quick. You can also save plenty of dollars if there are no conflicts since you may not need a mediator. Additionally, the paperwork procedure is also streamlined, saving you plenty of time. 

Do you need to hire a divorce lawyer for an uncontested divorce?

You are not obligated to hire a divorce lawyer when you file for an uncontested divorce. Whenever both the parties agree on all the terms, and there is no conflict in any aspect, you can file for an uncontested divorce without a lawyer. 

However, if you have children and assets involved, you should consider hiring a lawyer. An experienced lawyer can review the agreement with your partner and ensure you get a fair share. Additionally, your lawyer can also help communicate with your partner to make sure your demands and needs are met when agreeing on various aspects.
